Purchasing the download of a PassPrep product entitles you to activate (install) the program two times.
You are entitled to use the program, once installed, for as long as you want. The activation code, however, expires six months from date of purchase. You must install the program within this period.
You are not allowed to copy the program, in whole or in part, to any other computer or medium.
You may not run the product on a network. Each computer or workstation must have its own activation code.
Performance Programs Company Software License Agreement
PLEASE READ THIS SOFTWARE LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE BUYING. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, PLEASE DO NOT BUY.
1. License. The software and documentation are licensed to you by Stephen Mettling and David Cusic dba Performance Programs Company. You own the media on which the Performance Programs Software is recorded but Performance Programs and/or Performance Programs' licensor(s) retain title to PassPrep. The Performance Programs Software in this package and any copies which this License authorizes you to make are subject to this License.
2. Permitted Uses and Restrictions. This License entitles you to install PassPrep a total of two times over a period of six months from the date of purchase. Once installed, there is no limit on how long you may use PassPrep. The does not allow you to copy any parts of PassPrep to any computer other than the ones you originally install it on or to any other medium. It does not allow you to run PassPrep on a network. Except as expressly permitted in this License you may not decompile, reverse engineer, disassemble, modify, rent, lease, loan, sublicense, copy, distribute, or create derivative works based upon PassPrep in whole or part or transmit PassPrep over a network or from one computer to another.
3. Limited Warranty on Media (if applicable). Performance Programs warrants the media on which PassPrep is recorded to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of original retail purchase. Your exclusive remedy under this paragraph shall be at Performance Programs' option a refund of the purchase price of the product containing PassPrep or replacement of PassPrep which is returned to Performance Programs. THIS LIMITED WARRANTY AND ANY IMPLIED WARRANTIES ON THE MEDIA INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF ORIGINAL RETAIL PURCHASE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS SO THIS LIMITATION MAY NOT APPLY TO YOU. THE LIMITED WARRANTY SET FORTH HEREIN IS EXCLUSIVE AND IN LIEU OF ALL OTHERS WHETHER ORAL OR WRITTEN EXPRESS OR IMPLIED. PERFORMANCE PROGRAMS SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY JURISDICTION.
4. Disclaimer of Warranty on Performance Programs Software. You expressly acknowledge and agree that use of PassPrep is at your sole risk. PassPrep is provided "AS IS" and without warranty of any kind and Performance Programs and Performance Programs' licensor(s) (for the purposes of provisions 4 and 5 Performance Programs and Performance Programs' licensor(s) shall be collectively referred to as "Performance Programs") EXPRESSLY DISCLAIM ALL WARRANTIES AND/OR CONDITIONS EXPRESS OR IMPLIED INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY OR SATISFACTORY QUALITY AND FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS. PERFORMANCE PROGRAMS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN PASSPREP WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF PASSPREP WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN PASSPREP WILL BE CORRECTED. FURTHERMORE PERFORMANCE PROGRAMS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF PASSPREP OR RELATED DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PERFORMANCE PROGRAMS SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.
5. Limitation of Liability. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL PERFORMANCE PROGRAMS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS LICENSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Performance Programs' total liability to you for all damages exceed the amount of the original purchase price.
6. Use of Software. The software and accompanying documentation that are made available to download or to install from electronic media are the copyrighted work of Performance Programs Company. You may not decompile, reverse engineer or otherwise attempt to discover the source code of this software application. You are prohibited from using software from this or any other Performance Programs site to create a product of any kind that is in any manner unlawful, threatening, libelous, defamatory, obscene, pornographic, or that would violate any law or the rights of others.
7. Complete Agreement. This License constitutes the entire agreement between the parties with respect to the use of PassPrep and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by Performance Programs Company. The parties hereto confirm that they have requested that this Agreement and all related documents be drafted in English.
